Suspect charged in deadly shooting at west Birmingham home

NewsDerrick Rasard Gray, of Pleasant Grove, is charged with capital murder in Tuesday killing of 54-year-old Brian Montez Swain.(Birmingham City Jail)By Carol Robinson | crobinson@al.comA 50-year-old suspect has been charged in the fatal shooting of another man during an argument at a Birmingham home.Derrick Rasard Gray, of Pleasant Grove, is charged with capital murder in the Tuesday killing of 54-year-old Brian Montez Swain.West Precinct officers responded about 6:20 p.m. Tuesday to a report of a person shot in the 5900 block of Jesse Owens Avenue.Police arrived to find Swain unresponsive.The Birmingham Fire and Rescue Service pronounced him dead on the scene at 6:43 p.m. from multiple gunshot injuries, including a wound to the head.The charge is capital because Swain was inside a residence when he was killed. Gray is accused of firing into the home from the outside. A man was fatally shot Tuesday, Sept. 8, 2026, inside a home on Jesse Owens Avenue in west Birmingham.(Carol Robinson)Police have said the fatal shooting followed an argument. The nature of the argument has not been disclosed.Gray was taken into custody the same night as the shooting and booked into the Birmingham City Jail.The warrant was obtained Thursday. Gray will now be moved to the Jefferson County Jail where he will be held without bond.
