$33M award for diverting assets before bankruptcy
DALLAS — A federal court in Texas granted default to a restaurant operator and real estate company in their suit related to the diversion of a restaurant’s assets before its bankruptcy. They sufficiently brought claims for fraudulent transfers, breach of fiduciary duty, unjust enrichment and aiding and abetting. The court awarded the restaurant operator and real estate firm more than $33 million in damages.
