Tennessee ‘abortion trafficking’ law violates First Amendment

CINCINNATI — The Sixth Circuit upheld a Tennessee federal court’s ruling that found a portion of state law forbidding the recruitment of minors to obtain abortions out of state violates the First Amendment. Without considering whether the provision is unconstitutionally vague, the majority ruled that the law constitutes unconstitutional viewpoint discrimination and is facially overbroad. The lower court’s permanent injunction is affirmed.
