Charlie Kirk's family say they will SUE Utah college and police for litany of failures that led to MAGA star's assassination

Charlie Kirk's family has signaled that they intend to sue a number of Utah authorities in the wake of the MAGA star's assassination last year.Kirk's family said in a new notice of claim that there was a 'series of stunning failures and reckless decisions' in the lead-up to his death on Utah Valley University's campus on September 10, 2025.The new document comes just a few days after the one year anniversary of his untimely death, which rocked the conservative world and beyond. The Turning Point USA founder was 31 when he was killed during an outdoor event at the college while taking questions from an audience of around 3,000 people as part of his organization's American Comeback Tour.His alleged assassin, Tyler Robinson, is awaiting trial for murder. He faces the death penalty if found guilty. Now, his family claims the university failed to conduct a 'meaningful risk assessment' before the event, including failing to scout out rooftops near to the event space where Robinson allegedly fired from. Kirk's family alleged that UVU Police also did not have a written security plan and failed to hold any security briefings ahead of the event. The notice, seen by the Daily Mail, read: 'Through a series of stunning failures and reckless decisions, the UVU Parties created a foreseeable danger to Charlie.'Kirk's family said they have not assessed a monetary amount for damages they intend to seek against Utah authorities, but said the 'potential damages are substantial.' 'The risk of a rooftop shooter should have been especially top-of-mind given the attempted assassination of President Trump, Charlie Kirk's close friend and political ally, by a rooftop shooter the previous year,' the notice stated. Kirk's family notice names State of Utah, Utah Valley University (UVU), the Utah Valley University Police Department, campus police chief Jeffrey Long, Astrid Tuminez, who was UVU's president at the time of the assassination, and 'other state actors.' In response to the filing, Utah Valley University head of communications Sharon Turner told the Daily Mail: 'We are aware of the notice of claim. UVU addresses legal matters consistent with our established processes. Our focus remains on supporting our campus community.'The Daily Mail has contacted the Utah Valley University Police Department for comment. Kirk's family criticized UVU Police in the notice for only deploying six campus police officers for the event, representing only 25 percent of the UVU police force despite over 3,000 attendees being at the event. Following Kirk's assassination, prosecutors released security footage showing the shooter running across a rooftop to a 'sniper's nest' before taking the fatal shot. Kirk's family accused UVU authorities of failing to monitor CCTV footage in real-time, which they say would have allowed them to see the shooter preparing, and 'Kirk’s tragic death could have been avoided.' Instead, Erika shared a poignant message to social media, saying she has endured the 'unimaginable' since Charlie was killed.She shared a picture of herself walking with their two young children, as she wrote: 'To every person who has loved us, prayed for us, and carried our children and me before the Lord, not only today, but every day this past year... From the deepest place in my heart, thank you.'God, in his mercy, has used so many of you to steady us through the unimaginable. I will never have the words to adequately express what your love and prayers have meant to our family.'My Charlie... our babies and myself love you with everything we have.'We will carry you with us in our hearts forever and we thank God for every day He gave us with you.'Thank you for being the love of my life.'Erika also marked the day with a post from her wedding day to the conservative activist, showing them holding hands at the altar with the caption: '... until Heaven.'
